Occupancy Group for Small and Large Family Day Care
This question is to determine the proper occupancy class for the use of small and large family day care in an apartment or nonresidential building. CBC sections 205, 305.1 and 310.15 define requirements for small and large family day care uses. According to my reading, these sections give clear exceptions for day care in a single family home: occupancy is R-3 for up to 14 persons. The code appears silent on duplexes, apartments and all other nonresidential uses. Here are my questions:
1. What occupancy requirements do you apply for small family day care in a dwelling in a multi-unit residential building?
2. What occupancy requirements do you apply for large family day care in a > multi-unit residential building?
3. What occupancy requirements do you apply for 6 or less persons in a > nonresidential building?
